1. General Provisions.
1.1. The Agreement "About holding the International Online Festival "Golden Time"(hereinafter referred to as the Agreement) defines the conditions and procedure for organizing and conducting the International Online Festival "Golden Time" (hereinafter referred to as the Contest), conducted remotely (hereinafter - the Organizer of the contest) and in accordance with Article 633, 641 of the Civil Code of Ukraine is a public offer addressed to individuals (hereinafter referred to as the Participants), on the provision of the opportunity to participate in the Contest on the terms of this Agreement. The terms of the Agreement are the same for all consumers, the unconditional acceptance of the terms of which (payment in any way in accordance with Part 2 of Article 642 of the Civil Code of Ukraine) is considered an acceptance of this Agreement between the Customer and the Contest Organizer and certifies the fact of its conclusion. The diploma is not a confirmation of the academic degree. The diploma is the marketing name of the contest. The country of the contest is the name of the contest and is indicated in the name of a specific contest.

1.2. When jointly mentioned in the text of the Agreement, the Contest Organizer and the Participant are referred to as the "Parties", and each of them individually is referred to as the "Party".
1.3. Each Party guarantees to the other Party that it has the necessary right - and legal capacity, as well as all the rights and powers necessary and sufficient for concluding and executing the Agreement in accordance with its terms.
1.4. The current version of the Agreement is permanently posted on the website of the Contest Organizer at the address: "https://golden-time.uk.com/accept
" and is obligatory for familiarization by the Participant until the moment of acceptance.
1.5. The information resources of the Contest (hereinafter referred to as the Site) are the addresses of the pages on the Internet, which are indicated in Attachment 1 to this agreement.
1.6. The contest organizer unilaterally has the right to change the content of the Agreement in order to bring it into line with the changed legislation. The contest organizer may deposit the above changes without prior notice to the Participant. Changes to the contents of the Agreement come into force from the moment of their publication at the address of the permanent placement of the Agreement in the form of an updated text of the Agreement. 2. Terms and definitions used at the Agreement.
2.1. For the purposes of this Offer, the following terms are used in the following meaning:
"Offer" - this document is a Public Offer to provide information services and data processing services.
"Acceptance of the Offer" – is a full and irrevocable acceptance of the terms of the Offer.
The Acceptance of the Offer involves the Offer Agreement:
"Participant" - a person who has accepted the Offer and thus becomes a customer of the Services of the Contest Organizer under this agreement.
"Competitive contribution" - the cost of the Participant's participation in one contest program.
"Offer Agreement" - an agreement between the Contest Organizer and the Participant for the provision of Services, which is concluded through the Offer Acceptance.
"Service list" - a set of services defined by the Regulation on the International Online Festival "Golden Time London II Online" for customer service, published on the website for the International Online Festival "Golden Time London II Online". Service list provided in the Regulation is an integral part of this offer.
"Price-list" - the current systematized list of information services of the Contest Organizer with prices, given in the attachment to this offer.
"Jury" - activist of culture and art of Russia, the CIS and Far Abroad, composers, teachers, representatives of the media, show business, appointed by the Organizer of the contest and evaluating the work of the Participants, and determining the winners, the main winner of the Contest based on its results.
* The quantity and structure of the jury could be changed by the organizing committee without warning.
"Winner" - the Participant of the Contest, who got the Grand Prix, 1 (first), 2 (second) or 3 (third) place in the Contest in accordance with the Rules.
"News" (or Post) is an informational publication posted by the Organizer in the Community news feed.
"Account" - the page of the Organizer or Participant in the social network Internet.
"Video clip" is an audio-visual recording made by the Participant using any recording device that meets the requirements of these Rules.
"Contest" - International Online Festival Golden Time London II Online
"Organizer of the contest" - Golden Time Show LLC registered at: Ukraine, Krivoy Rog st. Pavel Glazovy 26a, realizes out operational management of events within the framework of the Contest; - approves the Contest Agreement; - places information about the Contest on the Channel, Website and in the media; - sets the procedure for conducting and registering the results of the Contest; - organizes rewarding of winners of the Contest; - provides technical and other support for the Contest; - for the duration of the Contest forms the jury (hereinafter referred to as the Contest Jury);
"Participant of the contest" - a person taking part at the contest who has reached the age of eighteen, or the parent of a minor, or his legal guardian, or another person representing his legitimate interests in accordance with the laws of Ukraine.
If the participant has not reached adulthood, the application is made by his legal representative. Students are allowed to take part at the contest (through parents, guardians, or persons representing their legitimate interests in accordance with the laws of Ukraine), teachers of state and non-state educational institutions of all types and levels of education, as well as persons with a musical education who graduated from educational institutions of any level.
"Channel" is a service platform https://golden-time.uk.com

, which allows you to download contest video clips of participants and winners of the contest.
"Site" - a hardware-software complex on which all official and legal documents of the Contest are posted, as well as documents through which the participants of the Contest are informed on the Internet about the progress of the Contest and its results, has an address on the Internet: https: / /golden-time.uk.com
, and the email address of the Contest firstname.lastname@example.org. 3. Subject of the Agreement.
3.1. The agreement defines the conditions and procedure for organizing and conducting the Contest by the Organizer of the contest, as well as the conditions and procedure for the Participant to participate in the Contest.
3.2. Any individuals over 18 years of age who submit their work to the Contest and the legal representatives of a minor (parents, guardians and other persons representing his legitimate interests in accordance with the laws of Ukraine) who expose it's work performed by a minor from 3 years old can become participants in the Contest (If the participant has not reached adulthood, the application is made by his legal representative)
3.3. The dates of the Contest are determined by the Contest Organizer and posted on the Site. The timing of the contest can be changed at the discretion of the organizers of the contest.
3.4. The order of participation in the contest: - filing an application for participation at the contest; - payment of registration fee; - sending contest videos and copies of documents on payment of the registration fee; - determination of the composition of the Participants and preparation of contest videos in electronic form in accordance with the requirements specified in the regulation on the contest; - summarizing.
3.5. Songs are allowed to sing in any language
3.5.1 The organizers don't restrict participants in their creative manifestations when submitting entries, but the jury evaluates according to certain criteria (stage culture, stage freedom and artistry, level of mastery of performance, complexity and originality of performance, dramaturgy of the work and direction, acting). The participant who used the processing, backing vocals, adjustments and other technical changes takes responsibility for the correctness of the evaluation of the submitted contest work, as the technical adjustment and processing do not allow to fully evaluate the skill of the participant. The organizers can ask the participant to replace the contest work, as well as disqualify the participant if the submitted competition program violates the format of the contest, rights of copyright holders, common to all mankind principles.
3.5.2 If the participant before the end of the application period has not given a contest work (full registration form), this participant will be disqualified without refund of the registration fee.
3.6. The goal of the Golden Time London II Online International Online Festival is to promote talented young people who create and perform new music, which is born at the intersection of styles and genres, and in one way or another intersects and interacts with classics today - rock, jazz, pop, electronic music.
3.7. Links for downloading the Contest videos are sent by the Participant or the Legal Representative of the Participant to the address of the Contest Organizer "in @ golden-time.uk.com" within the time period specified in the Regulations on the Contest.
3.8. Listening to the contestants is conducting by the organizers of the contest and members of the jury.
3.9. The dates of the contest are determined by the Regulations on the festival, which is an integral part of the Agreement. The contest is considered to be held from the moment the jury determines the winner.
3.10. To participate in the contest, contestants must fill out the Application Form (from https: // golden- time.uk.com
) no later than 2019, to add video material and send it to the organizers of the contest.
3.11. The video material should be a recording of the participant's live performance. The procedure for the provision of video material is indicated in Attachment 2 to the Regulation on the contest.
3.12. Video material for participation at the contest is accepted after payment, in accordance with clauses 9.2, 9.9 of this Agreement. Without payment, works will not be accepted.
3.13. Contest entries are sent by the Participants to the contest address email@example.com within the time periods specified in the Regulations on the festival. Works must be executed in accordance with the requirements specified in the Agreement and in the Regulation on the contest. Contest entries are not edited, reviewed by the Contest Organizer and the Jury and are not returned to the Participants. Informing participants about all the events related to the contest is carried out on the Site. The posting of any official information on the Site is the official procedure for informing. Each participant is considered to be informed in an appropriate way from the moment of publishing information on the Site. Reports on the results of the Contest, as well as award materials, are published on the Site.
3.14. The contest organizers have the right to use video, photo and audio materials provided by the participant for marketing purposes without transferring ownership of the work to them.
3.15. Each Participant accepts that participation in the contest is voluntary, and the Organizer of the contest is not responsible for the content of copyright materials and cannot guarantee and does not promise any specific results from participating in the contest and / or using the contest website and / or its services.
3.16. The organizer of the contest has the right to request an identification document from any participant in the contest; registration address, exact mailing address, other documents and information necessary to comply with the laws of Ukraine and / or to organize and conduct the contest, in the form of scanned copies or notarized documents.
3.17. Participants do not have the right to publish in the public domain personal data (phone, address of residence, etc.) of both their own and third person.
3.18. The participant agrees not to infringe the copyrights of third person. For violation of the established procedure for participation in the Contest established by the Agreement, or non-compliance with applicable law, the Participant's work may be removed from the Contest without providing supporting documents, as well as at any stage of participation in the Contest.
3.19. For violation of the established procedure for participation in the Contest established by the Agreement, or non-compliance with the current legislation of Ukraine, the Participant may be removed from participation in the Contest without providing supporting documents, as well as at any stage of participation in the Contest.
3.20. If the Participant does not submit the electronic work in electronic form in the manner prescribed by the Agreement or if it is submitted in a format not agreed with the organizers of the contest, as well as provide incorrect accompanying data or details, the author of the work assumes all risks and consequences of invalidating the work.
3.21. Base for exclusion of the participant from the contest: violation of the rules for participation in the Contest set forth in the Agreement; disrespect for the Contest Jury; failure to submit the contest work in the manner and terms specified in the Agreement in the Regulations on the festival. This list is not exhaustive. 4. Registration of contest work.
4.1. Contest work is submitted in the form of one video file of a popular format (at the choice of the Participant), with a total volume of not more than 5000 MB. If it is impossible to reproduce the file, the Jury of the Contest has the right to request from the Participant materials for work in a format convenient for it.
4.2. Works larger than 25,000 MB are not accepted for the Contest.
4.3. For sending by e-mail, the folder with the contest materials is archived according to the ZIP standard and must have the extension ".zip". The contents of the archive should not be closed in any way (password, key, etc.).
4.4. When sending archives with contest work by e-mail to the address of the Organizers of the firstname.lastname@example.org, the following should be write in the text of the letter:
4.4.1. Full Name of the Participant;
4.4.2. Full Name of the minor author of the work, if the Participant represents the work of the minor;
4.4.3. Work title; 5. Incentive measures for the participants of the Contest
5.1. The jury has the right to reward the Contestants with award documents of the sample established by the Contest Organizer. 6. The procedure for determining and rewarding the winners of the Contest
6.1. The prize fund is formed at the expense of the Contest Participants, the Sponsors and the organizers of the Contest. The funds of the prize fund are used to support the activities of the Organizer of the Contest, including the organization of the Contest.
6.2. Winners of the Contest are determined by the Jury members by secret ballot, based on the results of the consideration submitted by the Participants of the contest works.
6.3. To evaluate the Participants of the contest and determine the winners of the contest, the organizers of the contest send each of the jury members, in electronic form, the contest works of the Participants in the contest.
6.4. Evaluation of the Festival Participants is realized by the jury in the manner prescribed by the Regulation on holding the online festival, based on the results of viewing, listening to contest works.
6.5. Each member of the jury evaluates the entries in the country of which he is a resident during the contest or in which he resides at the time of the evaluation of the works. The contest is actually held in the country of residence of each jury member.
6.6. The decision of the Jury on determining the winners of the Contest is final, not subject to appeal, and shall enter into force from the moment of its publication on the Site.
6.5. The list of winners is communicated to the public through an announcement on the Site. The winner will be notified of the fact of taking the prize place by e-mail and / or by posting an announcement on the Website and / or social networks (channels) of the festival 7. Consideration of applications of participants and dispute resolution
7.1. When fulfilling the Agreement, the participant has the right to send notifications, requests, claims, statements, complaints and other appeals to the Contest Organizer, both provided and not provided for by the Agreement, in one of the following ways (unless otherwise provided by the Agreement):
7.1.1. by reporting a complaint, claim or any other contact to the email address of the Contest Organizer: email@example.com
7.1.2. by providing the Participant with the receipt of the Contest Organizer's application on paper if the Participant's signature on such an application is notarized;
7.1.3. in another way agreed by the Organizer of the contest and the Participant. The organizer of the contest accepts for consideration only the applications of the Participant drawn up in Ukrainian or Russian.
7.2. In cases established by the Agreement or published on the Site, the Participant must provide the Contest Organizer with a written statement of the appropriate form and content.
7.3. After receiving a written application from the Participant, including a claim, the contest organizer is obliged to consider the application and report the results of its consideration to the Participant within the time period established by the current legislation of Ukraine.
7.4. The response to the application of the Participant (including the Claim) is sent to the participant by one of the methods chosen at the discretion of the Contest Organizer. If a decision is made to fully satisfy the claim, the Contest Organizer has the right to take appropriate actions without sending a response to the claim to the claimant. 8. Rights and obligations of the Parties
8.1. Rights of the Contest Organizer:
8.1.1. to refuse with register the Participant's contest work in the event of a discrepancy between the work requirements of this Agreement;
8.1.2. not to accept as confirmation of payment of the registration fee of the Contest Participant a copy of the document containing errors made by the Participant or another person when indicating the payment and other details of the Contest Organizer.
8.1.3. to process in any way for the purpose of fulfilling the Agreement any personal data of the Member provided by the Member personally, either through third parties at the time of conclusion, or during the term of the Agreement;
8.1.4. The Participant gives the Contest Organizer with exclusive rights to create, own, use and dispose of audio, video and photo materials (hereinafter referred to as the "Materials") that will be created in relation to the Participant during the Contest, on the territory of all countries of the world, for the entire term of copyright protection , which begins to be calculated from the moment the Parties sign this Agreement.
8.2. Member Rights:
8.2.1. to receive notifications about the processing of their application for participation at the contest in the manner prescribed by the Agreement;
8.2.2. to present claims to the Organizer of the contest and send other applications in the manner and cases provided for by the Agreement;
8.2.3. unilaterally refuse to execute the Agreement by notifying the Organizer of the contest in the manner prescribed by the Agreement.
8.3. Responsibilities of the Contest Organizer:
8.3.1. to notify the Participant of amendments to the Agreement by posting such a notice on the Website of the Contest Organizer, or by sending the Participant a notification in another way provided for by the Agreement;
8.3.2. to take measures to prevent unauthorized access by other people to information about the personal data of the Participant other than that published in an open form on the Site of the Contest Organizer;
8.4. Member Responsibilities:
8.4.1. to provide the Contest Organizer with reliable and relevant contact details;
8.4.2. in a timely manner to inform the Contest Organizer about changes in personal data, details and data in the documents submitted to the Contest, data for sending notifications;
8.4.3. to provide the Contest Organizer with information and documents required by the Contest Organizer as part of the execution of the Agreement
8.4.4. Participant gives to Organizer of the contest his consent to the processing of any personal data, in any way for the purpose of fulfilling the Agreement provided by the Participant personally, either through third parties, at the conclusion, or during the term of the Agreement. If, upon execution of the Agreement, the Participant provides the Contest Organizer with personal data of third parties, the Participant guarantees the legality of their receipt and the consent of the subjects of these personal data to provide them, and also assumes responsibility for the legality of the provision and the validity of the specified data;
8.4.5. The participant agrees that all the personal data provided to the Organizer of the contest will can be openly published on the Organizer's website and in other media.9. The procedure for conclusion and payment under the contract
9.1. The contract is concluded between the Organizer of the contest and the Participant in the form of a public contract (Articles 633, 641 of the Civil Code of Ukraine).
9.2. Acceptance of the terms of the Agreement is the Participant's fulfillment of the following action: - payment of the full amount of the contest contribution to the current account of the Organizer of the contest, either by direct payment or by transfer through online payment services, which the Organizer of the contest has the right to choose and change independently
9.3. The condition for participation in the Contest is payment of the contest fee.
9.4. The amount of the contest fee is determined in accordance with the tariffs specified in the Regulation on the holding of the international online festival, and is published on the website of the Contest Organizer.
9.5. The contest organizer has the right to unilaterally completely or partially change (increase, decrease), establish new, cancel existing competitive contributions. Moreover, these changes come into force from the day of publication of the changes on the Website of the Contest Organizer, unless otherwise provided by the Contest Organizer.
9.6. In case of disagreement with the application of the new contest fees, the Participant has the right to unilaterally refuse to execute the Agreement.
9.7. Regardless of the results of the contest, the contest fee paid by the Participant in the event of termination of the Agreement shall not be returned.
9.8. All settlements of the Parties are realized in Dollar, English Pound, Euro, Ukrainian Hryvnia. At the discretion of the organizing committee of the festival.
9.9. Payment of the contest fee under this Agreement is realized by the Participant in the form of a 100% prepayment according to any of the non-cash payment options specified in the payment methods for services on the website https://golden-time.uk.com/provvocal
, unless otherwise specified by an additional agreement (conditions) to this Offer Agreement.
9.10. Prepayment of the arrangement fee is not refundable. During 5 working days, you can return the prepayment in the amount of 50% by specifying the reason for the return by sending a letter to the mailing address specified in this Agreement, informing the organizer to Organising Committee
9.11. Acceptance of the terms of the Agreement means the full and unconditional acceptance by the Member of all the terms of the Agreement without any exceptions and / or restrictions and is equivalent to the conclusion of a bilateral written agreement. 10. Modification and termination of the Agreement
10.1. The parties agreed that the Contest Organizer has the right to amend the terms of the Agreement. Changes made by the Contest Organizer become binding on the Parties from the moment they are posted on the Site, unless otherwise provided by the Contest Organizer.
10.2. In case of disagreement with the amendment of the terms of the Agreement, the Participant has the right to unilaterally refuse to execute the Agreement within three calendar days from the date of posting the new version of the Agreement on the Contest Organizer's website by transmitting to the Contest Organizer an original copy of the signed application in paper form in the form established by the Contest Organizer .
10.3. If the Contest Organizer does not receive a written notice from the Participant about a unilateral refusal to execute the Agreement within the time period specified in clause 10.2. Of the Agreement, the Participant is deemed to have agreed with the amendments to the terms of the Agreement.
10.4. Refusal to execute the Agreement, break of the contract, termination of the Agreement for other reasons entails the termination of participation of the Participant in the Contest.
10.5. The Participant has the right at any time to refuse to execute the Contract by sending a corresponding notice to the Contest Organizer in the ways provided for by the Contract. In this case, the Agreement will be deemed terminated after 10 (ten) calendar days after the Contest Organizer receives the corresponding notice. The contest fee is not back to the Participant in this case.
10.6. The Contest Organizer has the right to unilaterally refuse to execute the Agreement by sending the Participant a corresponding notice in any of the ways provided for in the Agreement. In this case, the Agreement is considered terminated after 15 (fifteen) calendar days after the notification is sent 11. Responsibility of the Parties
11.1. In case of violation of their obligations under this Offer, the Parties bear the responsibility defined by this Offer and the current legislation of Ukraine.
11.2. The contest organizer is not responsible:
11.2.1. for failures in the work of third-party services, mail, the Internet, communication networks that arose due to reasons beyond the control of the Contest Organizer and which entailed the untimely receipt or non-receipt by the Participant of notifications of the Contest Organizer;
11.2.2. in case of technical failures (disconnection / damage to the power supply and communication networks, failures of the processing center software and technical failures in payment systems), which entailed the failure of the Organizer to comply with the terms of the Agreement;
11.2.3. for losses had incurred as a result of the Participant's incorrectly filling out instructions on the completion of the contest payment transaction;
11.2.4. for losses incurred as a result of violation by the Participant of the established procedure for depositing funds to pay the contest fee;
11.2.5. for losses resulting from the provision by the Participant of inaccurate, incorrect, erroneous data for sending notifications;
11.2.6. for losses incurred as a result of the provision by the Member of incorrect identification data; 12. Force Majeure.
12.1. The parties are exempted from liability for non-fulfillment of obligations if this non-fulfillment is caused by circumstances that do not depend on the will of the Parties, and martial law, namely: military operations, natural disasters, industrial and other accidents, strikes, lockouts, acts of government or administration, etc. etc., which makes it impossible to fulfill the terms of this Agreement (hereinafter referred to as Force Majeure).
12.2. Force majeure is applied, and the Party for which it has occurred is released from liability for violation of the terms of this Agreement, if there is written confirmation (conclusion, certificate) of the Chamber of Commerce and Industry of Ukraine or the country, where force majeure is happened or another authorized person body about the onset of force majeure.
12.3. The Party for which Force Majeure has occurred will immediately notify the other Party and provide documents confirming Force Majeure.
12.4. From the moment of receipt of such notification by the other party, the implementation of the terms of this Agreement is suspended for the entire period of force majeure.
12.5. In the event of force majeure for more than 3 months, each of the parties has the right to initiate the termination of the Agreement. 13. The order of information interaction of the Parties
13.1. When concluding the Agreement, the Participant must provide the Contest Organizer with reliable information to contact the Participant and send him notifications about the Contest. The participant is responsible for ensuring the consistency of the specified data with reality.
13.2. By default, the appropriate way to inform the Participant about a transaction with his application and contest work is to send a notification to the email address provided by the Participant in accordance with clause 13.1. Of the Agreement.
13.3. The Participant has the right at any time to change the previously selected notification method by providing the Contest Organizer with reliable information to contact the Participant and send him notifications in the manner established by the Contest Organizer.
13.4. In case of refusal of the Participant from all the methods proposed by the Contest Organizer to send notifications to the Participant about operations with the application and contest work, the Participant will be deemed not to have properly provided information for communication with the Participant in accordance with clause 13.1, and the Contest Organizer will be deemed to have fulfilled its obligations to inform the Participant about perfect operations with the application and contest work. In this case, the Participant is not entitled to submit claims to the Contest Organizer related to improper informing of the Participant about operations.
13.5. The responsibility of the Contest Organizer to inform the Participant about the transaction with the application and contest work is considered fulfilled at the time of sending the corresponding notice. The notification will be considered received by the Participant within 24 hours from the date of sending. The Contest Organizer is not responsible for the Participant's lack of access to the means by which the Participant can receive a notification, or untimely receipt of a notification, including for malfunctions of the Internet, communication networks that arose due to reasons beyond the control of the Contest Organizer and entailed untimely receipt or non-receipt by the Participant of notifications of the Contest Organizer.
13.6. The Contest Organizer has the right, at its discretion, to send the Participant any other notifications (including those generating legal consequences), answers to applications, claims and other appeals, in one of the following ways:
13.6.1. by posting on the Site of the Contest Organizer;
13.6.2. to the Member's email address provided in accordance with clause 13.1. and / or indicated by him in any written application previously received by the Contest Organizer; When sending notifications in accordance with subparagraphs 13.6.1.-13.6.2. The agreement will be deemed to be received by the Participant after 24 hours from the date of notification 14. Other provisions
14.1. The participant guarantees that all the conditions of the Agreement are clear to him, and he accepts them unconditionally and in full.
14.2. The participant guarantees that he will not use the Contest for illegal aims, as well as for aims other than those specified in the Agreement.
14.3. The material and procedural law of Ukraine will apply to the relations between the Parties under the Agreement regardless of the citizenship and place of residence of the Participant.
14.4. The Contest Organizer is a single tax payer
14.5. The Contest Organizer is not registered as a VAT payer and is not such.
14.6. Free Diplomas will be sent to all participants in electronic form upon request. We accept requests by e-mail firstname.lastname@example.org The Organizing Committee is not responsible for the participant not submitting an application for an electronic diploma. Electronic diplomas are sent without the signature of the jury, as the serial number of the diploma in conjunction with the evaluation of the jury in the contest table is a factual confirmation of the participant's assessment. Correspondence with participants through official communication channels is the official position of the organizers of the committee
